Reclamation Certification for Select Parcel of Lands Within Mine No. 1788

The Alberta Energy Regulator (AER) has received Coal Conservation Act (CCA) Application No. 1927912 and Environmental Protection and Enhancement Act (EPEA) Application No. RC00459362 from Westmoreland Mining Holdings LLC (Westmoreland) on behalf of Capital Power GP Holdings Inc.

As part of its progressive reclamation process, Westmoreland on behalf of Capital Power GP Holdings Inc. is seeking approval for the abandonment and reclamation of select parcels of land within its Genesee mine No. 1788 located in Leduc County approximately 20 km north of Warburg, Alberta. This notice sets out the deadline for filing a statement of concern under the section How to File a Statement of Concern.

Description of the Applications
Westmoreland applied under the CCAfor the abandonment of 28.64 ha of land located in the following legal land descriptions:

  • NE/NW-19-50-02W5M
  • NE/NW/SE-20-50-02W5M
  • 21-50-02W5M
  • 28-50-02W5M
  • SE/SW-29-50-02W5M
  • SE/SW-30-50-02W5M

The abovementioned 28.64 ha area was mined and backfilled. The majority of the area was reclaimed to an agricultural end land use or as part of the county road network.

Under the EPEA application, Westmoreland applied for approval of a reclamation certificate for 5.50 ha of land located in the following legal land descriptions:

  • 05-29-50-02W5M
  • 06-29-50-02W5M

No coal was removed but mining-related disturbances, including reclamation material storage, light vehicle and haul road construction, did occur on the abovementioned area. The reclamation certificate area has been reclaimed to an agricultural end land use.

Requirement to File a Statement of Concern
If you have concerns with these applications, you must file a statement of concern as described below. If you do not file a statement of concern, the AER may approve the applications without further notification.

How to File a Statement of Concern
For your submission to be considered a valid statement of concern, it must be filed before 4:00 p.m. on May 12, 2020.

Contents of a Statement of Concern
For your submission to be considered a valid statement of concern, it must include:

a) why you believe you may be directly and adversely affected by a decision of the AER on the applications;

b) the nature of your objection to the applications;

c) the outcome of the applications you advocate;

d) the location of your land, residence, or activity in relation to the location of the energy resource that is the subject of the applications; and,

e) your contact information, including your name, address in Alberta, telephone number, and email address or, if you do not have an email address, your fax number.

The AER also requests that you include the application numbers in your statement of concern.

Confidentiality
Section 49 of the Alberta Energy Regulator Rules of Practice (Rules of Practice) requires that all documents and information filed in a proceeding be placed on the public record. If you file a submission, you must not include any personal information that you do not want to appear on or are not authorized to put on the public record. Section 49(2) of the Rules of Practice states how to apply to the AER for an order to keep information confidential. The Rules of Practice are available on the AER website at www.aer.ca.

Jurisdiction
Submissions relating exclusively to compensation for land use are not dealt with by the AER and should be referred to the Alberta Surface Rights Board.

Under section 21 of the Responsible Energy Development Act, the AER does not have the jurisdiction to assess the adequacy of Crown consultation associated with the rights of aboriginal peoples as recognized and affirmed under the Constitution Act, 1982.
